
Malfunction and Replacement machine request
The operator may request a replacement cash register from the service provider if their own cash register breaks down.
The operator has a so-called reporting obligation to the service provider, thereby recording the fact of the fault and at the same time being exempted from the obligation to issue machine receipts. The service center records the fault and prepares for repair, for which it has 5 days.
The service center or distributor has 15 days to carry out the repair itself. If the repair process exceeds this period, a replacement cash register must be requested. The service center or distributor has 8 days to install the replacement machine.
However, few people know that it is the operator's responsibility to notify the service center and thus the distributor that they want to use a replacement machine for the duration of the repair, not the service center's. If this is not done, the service provider cannot be held liable for any penalties imposed by the National Tax and Customs Administration.
There are two paragraphs on this in the relevant government decree.
1. 48/2013. (XI. 15.) NGM decree 1§ 3. point 2. paragraph - 15-day fault reporting obligation
"The exemption referred to in this paragraph shall only apply at the point of sale concerned and in the event of a cash register malfunction, from the occurrence of the malfunction until the cash register is repaired or a replacement is provided, or until the cash register put into operation in place of the malfunctioning cash register is put into operation, but no later than 15 days from the date of the malfunction."
2. 48/2013. (XI. 15.) NGM Decree 42§ 1. point - 8 days from the date of the request
"At the operator's request, the distributor is obliged to provide a replacement cash register within 8 days of notification for the duration of the repair."
